OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards associated with improper automobile lift operations: (a) On or about July 29, 2015, and at times prior, Cosey, LLC., employees were exposed to crushing and struck-by hazards while working on automotive lifts as follows: 1 - Lifts were not inspected annually by a qualified lift inspector. 2 - Lifts were not inspected daily during use to ensure that they were properly maintained and functional. 3 - Lift #1 Did not have capacity labels, operator did not know its capacity. 4 - Lift #1 Was missing the padding on the swing-arm base. 5 - Lift #2 Worn out padding on the swing-arm bases. 6 - Lift #6 Locks on swing-arms do not engage.
