29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:    a. On or about July 30, 2015, at the above addressed jobsite, employees were provided with and required to wear full-face respirators for use during tuckpointing operations. The employer did not develop or implement a written respirator program that included the provisions of this section including, but not limited to worksite specific procedures.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    b. On or about July 30, 2015, at the above located jobsite, employees performing tuckpointing operations were exposed to the hazards associated with chemicals such as, but not limited to silica. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold:    a. On or about July 30, 2015, at the above addressed jobsite, employees conducting tuckpointing operations from a tube and coupler scaffold, approximately thirty (30) feet above the lower surface, were not protected from falls, thereby exposing employees to hazards associated with falls.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews:    a. On or about July 30, 2015, at the above addressed jobsite, employees conducting tuckpointing operations from a tube and coupler scaffold, approximately thirty (30) feet above the lower surface, which was not provided with a complete guardrail system, thereby exposing employees to the hazards associated with falls.

On or about July 30, 2015, at the above addressed jobsite, employees conducting tuckpointing operations from a tube and coupler scaffold approximately thirty (30) feet above the lower surface that was not fully planked, thereby exposing employees to fall hazards.
