29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. (a) Colorado Flatwork, Inc., at 3317 N. Syracuse St., Denver, CO 80238: On July 22, 2015, the employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that an employee was engaged in waterproofing the floor of an apartment balcony on the 2nd level without fall protection. The mid rail on the east end of the balcony was not secured to the building because its support was detached. This condition resulted in an employee falling approximately 12 feet, 4 inches to the ground below.
