This condition exposed employees to a fall hazard of four and one-half (4 feet, 6 inches) above the concrete floor level. (b) Generator 4506: On or about July 28, 2015 and at times prior thereto, the access platform for the generator was not guarded with a standard railing or equivalent. This condition exposed employees to a fall hazard of four and one-half (4 feet, 6 inches) above the concrete floor level. Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.

29 CFR 1910.101(a): The employer did not determine that compressed gas cylinders under his control were in a safe condition to the extent that can be determined by visual or other inspections conducted as prescribed in the Hazardous Materials Regulations: POL Warehouse: On or about July 28, 2015 and at times prior, two (2) compressed gas cylinders marked as containing R-12 refrigerant gas were noticeably pitted, dented, and certification(s) were illegible. This condition limited the employer's ability to ensure cylinders were safe for use and transport.
