29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.      (a) Jobsite, 490 Bessemer Road, Mt. Pleasant, PA:  On or about August 3, 2015 employees working in aerial lifts were not wearing a harness attached to the boom or basket exposing them to fall hazards up to 20 feet to the ground below.

Pleasant, PA:  On or about August 3, 2015 an employee engaged in steel erection activities approximately 20 feet above the ground was not protected from falling by the use of personal fall arrest systems, positioning devices, guardrails or safety net systems.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    (a) Jobsite, YMCA, 490 Bessemer Road, Mt. Pleasant, PA:  On or about August 3, 2015 employees who perform work from aerial lifts have not been trained by the employer or another qualified person to ensure the employees understood and were able to recognize the hazards associated with the type of scaffold being used.  Employees had not been trained to use personal fall arrest systems when working from an aerial lift.

29 CFR 1926.752(b): Commencement of steel erection. A steel erection contractor shall not erect steel unless it has received written notification that the concrete in the footings, piers and walls or the mortar in the masonry piers and walls has attained, on the basis of an appropriate ASTM standard test method of field-cured samples, either 75 percent of the intended minimum compressive design strength or sufficient strength to support the loads imposed during steel erection.  (a) Jobsite, YMCA, 490 Bessemer Road, Mt. Pleasant, PA:  On or about August 3, 2015 the steel erection contractor proceeded with the erection of the columns, beams and purlins without receiving written notification that the concrete in the footings and piers had attained either 75 percent of the intended minimum compressive design strength or there was sufficient strength to support the loads during steel erection in accordance with ASTM standard test methods.
