29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. The employer did not provide training, instructions, or work rules in the recognition and avoidance of dump body tailgate hazards. On August 4, 2015, an employee was fatally struck-by a dump body tailgate.

29 CFR 1926.600(a)(3)(i): Heavy machinery, equipment, or parts thereof, which are suspended or held aloft by use of slings, hoists, or jacks shall be substantially blocked or cribbed to prevent falling or shifting before employees are permitted to work under or between them. Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, shall be either fully lowered or blocked when being repaired or when not in use. All controls shall be in a neutral position, with the motors stopped and brakes set, unless work being performed requires otherwise. a. The employer did not ensure employees were protected from the hazards of a suspended dump body tailgate when verifying that all material was removed after dumping, thereby exposing employees to a struck-by hazard. On August 4, 2015, an employee was fatally struck-by a dump body tailgate.
