29 CFR 1926.503(c): When the employer had reason to believe that any affected employee who had already been trained did not have the understanding and skill required by paragraph (a) of this section, the employer did not retrain each such employee: a) Job site, 101 Ohio Road, Avalon, PA: On or about August 5, 20115, during gutter installation activities, the employer did not ensure that the employees followed fall protection training protocols in that they worked in an area where they were exposed to fall hazards of approximately 12 to 14 feet and no fall protection was used.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails were not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder: a) Job site, 101 Ohio Road, Avalon, PA: On or about August 5, 20115, during gutter installation activities, the employer did not ensure that the ladder used to gain access to/egress from the roof was extended at least 3 feet above the roof line or that is secured and that a grab bar was provided.
