29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request.        a) At the Arkport Bin, on or about 8/5/2015: The fire extinguishers in each bay were not subjected to an annual       maintenance check, and the annual maintenance date was not recorded and retained as required.

29 CFR 1910.157(g)(1): Where the employer has provided portable fire extinguishers for employee use in the workplace, the employer shall also provide an educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting.        a) At the Arkport Bin, on or about 8/5/2015: The employer did not train its employees in fire extinguisher use and         hazards of incipient stage firefighting.         Abatement Note: By this date the employer must either correct the alleged violation(s) or implement a Fire Safety       Policy, as outlined in 29 CFR 1910.38 and 29 CFR 1910.39 which includes the evacuation requirements of 29 CFR        1910.157(b).

Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.        a) At the Arkport Bin, on or about 8/5/2015: Electrical outlet boxes were not properly installed, as they were       not enclosed or flushed with the finished surface.         b) At the Arkport Bin, on or about 8/5/2015: Electrical outlet box was held in place with duct tape and not rigidly       supported or properly secured.         c) At the Arkport Bin, on or about 8/5/2015: An electrical outlet box was not enclosed in the wall and the side and        back ends extended out into the work area.        d) At the Arkport Bin, on or about 8/5/2015: Electrical outlets were installed back-to-back within the same box.

29 CFR 1910.305(b)(2)(i): All pull boxes, junction boxes, and fittings shall be provided with covers identified for the purpose. If metal covers are used, they shall be grounded. In completed installations, each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear.        a) At the Arkport Bin, on or about 8/5/2015: Electrical outlet boxes did not properly enclose live parts, as the boxes        did not have faceplates.
