29 CFR 1926.20(b)(2): Such programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer:    At the jobsite, the employer failed to ensure that frequent and regular inspections of equipment was made by a competent person.  The following hazards were noted:    a)  Employees accessed the work platform of a scaffold by climbing up structural members not designed for scaffold access.    b)  Employees used a scaffold with the rear left caster in the un-locked position.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.          (a)  At the 3100 McKinley address employees were accessing the work platform of the mobile scaffold by climbing on structural members not designed to be used as scaffold access.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    (a) At the 3100 McKinley Ave Work site the site supervisor, who indicated he was the assigned competent person,  did not perform as a competent person in that workers worked from the scaffold while a rear caster was un-locked.  Workers also climbed the side frame of the scaffold while the supervisor was in visual contact.

29 CFR 1926.454(a)(5): The employer failed to have each employee who performs work while on a scaffold trained in any other pertinent requirements of this subpart:    (a)  At the 3100 McKinley Ave Work site, employees thought OSHA standards allowed workers to climb up the structural members of a single section of scaffolding to access the scaffold platform in the absence of integral prefabricated scaffold access and in the absence of scaffold access as prescribed by 29 CFR 1926.451(e)(1).
