OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to a struck by hazard from the forklift tipping over. (a) Warehouse - On or about July 30, 2015 employees operating the Toyota forklifts did not use the seatbelts when operating forklifts.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: (a) Warehouse - On or about July 30, 2015 employees were observed walking on a platform 55 inches high without standard guardrails. (b) Warehouse - On or about July 25, 2015 Toyota forklift was used to lift employees on a pallet to change out light bulbs and to perform inventory without standard guardrails.
