29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.    (a) MugShots Bar & Grill - On or about July 30, 2015 employees were working from a welded framed tubular scaffolding using wood planking that had gaps between the boards that ranged from 1 inch to as wide as 17 inches.

29 CFR 1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilivered end     (a) MugShots Bar & Grill - On or about July 30, 2015 employees were working on a welded tubular scaffolding that is 21 feet long with the platform extending more than 18 inches outside edge of frames. The cantilevered portion of the platform was not guarded or supported to keep from tipping.

29 CFR 1926.451(b)(7): On scaffolds where platforms were overlapped to create a long platform, the overlap did not occur only over supports, and/or was less than 12 inches (30 cm) when the platforms were not nailed together or otherwise restrained to prevent movement.  (a) MugShots Bar & Grill - On or about July 30, 2015 employees were working on scaffolding that had the platform splices overlapping less than 12 inches and located between the supports. The splices were not nailed together or fastened in a manner to prevent displacement.

29 CFR 1926.451(c)(2)(ii): Unstable objects were used to support scaffolds or platform units:     (a) MugShots Bar & Grill - On or about July 30, 2015 at the interior east side of the building legs of the 21 feet long, 5 feet wide by 12 feet high scaffolding used in brick application operations was placed on wood planks on top of  lower scaffolding in place of being on a level sound footing capable of supporting the scaffold without settling or displacement.

29 CFR 1926.451(h)(2)(ii): IAC 875 - Chapter 26 1926.451(h)(2)(ii): A toe board was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:    (a) MugShots Bar & Grill - On or about July 30, 2015 scaffolding erected more than 12 feet high lacked toe boards.  There were tool bags and work buckets sitting at the out side edge of the planks exposing employees to a struck by hazard.

29 CFR 1926.452(c)(2): Tubular welded frame scaffold(s) were not properly braced by crossbracing or diagonal braces, or both, to secure vertical members laterally and to align them so that the erected scaffold was plumb, square, and rigid:    (a) MugShots Bar & Grill - On or about July 30, 2015 employees were working from welded tubular frame scaffolding that was missing structural cross bracing. The center section of scaffolding on the west side of columns was missing cross bracing needed to tie in both ends of scaffolding to keep it plumb, square, and rigid.
