29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     a) New Cement Plant Building, on or about 8/4/2015: Excavator operator did not make sure that the area around the swing radius was clear before moving while an employee that was removing an acetylene tank was outside of the area. Employee on the ground was pinned between an excavator superstructure and a fixed beam, receiving serious injuries.

29 CFR 1926.602(b)(3): Safety requirements, ratios, or limitations applicable to machines or attachment usage covered in Power Crane and Shovel Associations Standards No. 1 and No. 2 of 1968, and No. 3 of 1969 were not complied with.  a) New Cement Plant Building, on or about 8/4/2015: Excavator operator did not make sure that the area around the swing radius was clear before moving while an employee that was removing an acetylene tank was outside of the area. Employee on the ground was pinned between an excavator superstructure and a fixed beam, receiving serious injuries.   b) New Cement Plant Building, on or about 8/4/2015: Excavator was operated without a windshield to dig the foundation for a beam, employee was exposed to flying material.
