29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. Road in front of 76 Elm Street, Northampton, Massachusetts; The modular trench box had shifted while being installed and the panels were not aligned causing a reduction in the protection capability of the trench box. One employee was working between the box and the trench wall and the other was working inside the box, in class C soil, at a depth of approximately 6 feet, manipulating the box in an attempt to align the box to insert the cotter pins to make the box rigid.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. Road in front of 76 Elm Street, Northampton, Massachusetts; Each employee in an excavation was not protected from cave-ins by an adequate protective system as required. Employees were setting up a trench box while inside the excavation. The employee in the partially assembled box was standing in an excavation that was approximately 6 feet deep.
