29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: (a) On or about July 10, 2015, and at times prior, the employer did not protect employees from crushing hazards while operating earthmoving equipment by requiring the operators to wear the provided seatbelts. The equipment included but was not limited to the Caterpillar 320E excavator, the Caterpillar 430F loader, and the Caterpillar 930K loader. Each was equipped with roll-over protection and seatbelts. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about August 10, 2015, and at times prior, employees were exposed to cave-in hazards while working in trenches with vertical walls of Type B soil which were greater than 5 feet in depth, without protective systems. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
