29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:    (a)  On or about July 10, 2015, and at times prior, the employer did not protect employees from crushing hazards while operating earthmoving equipment by requiring the operators to wear the provided seatbelts.  The equipment included but was not limited to the Caterpillar 320E excavator, the Caterpillar 430F loader, and the Caterpillar 930K loader.  Each was equipped with roll-over protection and seatbelts.      Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
