29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. (a) 493 Sagaponack Road, Bridgehampton, NY (Worksite), west side of residential home - On or about August 7, 2015, employees accessed the ladder jack scaffold using the same aluminum extension ladders that were supporting the work platform on the outboard side of the scaffold. This means of access required the employees to climb around the ladder jack brackets and aluminum plank in order to reach the working level of the scaffold. This exposed the employees who ascended and descended the scaffold in this manner to fall hazards, which ranged between 3' and 13'-6" to the ground below. Note: The employer is required to submit abatement certification for this violation, in accordance with 29 CFR 1903.19.
