OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught-in hazards:    (a) Seam Busting Area - The foot pedal, for actuating the Northampton Pinker, model NP, serial number 178, used to pink (cut a saw-toothed edge) on the bottoms of men's pants, did not have protection to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedal, exposing employees to the hazard of getting hands and fingers struck-by or caught-in the pinking shear, on or about August 5, 2015.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    (a) Franklin Clothing Company, Inc., 5121 Innovation Way, Chambersburg, Pennsylvania - Employees performed servicing and maintenance activities, such as cleaning and making repairs, on a variety of machinery and equipment, including, but not limited to, the GTxL auto cutter and the Northampton pinker, and the employer did not develop and implement a compete energy control program, consisting of machine specific energy control procedures, group lockout/tagout, testing and positioning procedures, periodic inspections, and employee training, exposing employees to hazards, including but not limited to, getting caught-in and struck-by moving machine parts, on or about August 11, 2015.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(3)(ii): Points of operation of machinery were not guarded to prevent employees from having any part of their body in the danger zones during operating cycles:    (a) Seam Busting Area - The Northampton Pinker, model NP, serial number 178, used to pink (cut a saw-toothed edge) on the bottoms of men's pants, did not have complete point of operation guarding in that this machine had a single piece of Plexiglas installed 2 inches in front of the point of operation.  Employees could reach over and around this Plexiglas guard and get fingers caught in the pinking shear.  Also, the rear side of the point of operation had no guarding, which allowed employees to reach into the rear side of the point of operation and get fingers caught in the pinking shear, on or about August 5, 2015.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:    (a) Seam Busting Area - The employer had junction boxes with knockouts on the sides, attached to plug-in jacks for use on the feedrail system, which supplied power 220-volt 3-phase AC electrical power to various apparel making machinery. The employer did not have these junction boxes with the knockouts on the sides installed in accordance with the boxes' listing, labeling, or certification in that the employer did not have the knockout boxes securely and rigidly mounted to the building or other support structure, exposing employees to injurious contact with electrical current, on or about August 11, 2015.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.304(g)(5): The path to ground from circuits, equipment, and enclosures was not permanent, continuous, and effective:    (a) Seam Busting Area - Equipment did not have a continuous and effective path to ground in that the metal BX jacket which serves as the ground for wiring for the motor to the on/off switch on the Northampton Pinker, model NP, serial number 178, did not attach to the motor and did not contain the wires at the motor, exposing employees to the hazard of injurious contact with electrical current, on or about August 11, 2015.    Abatement certification required within 10 days after abatement date.
