29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the construction site located at 320 Capitol of Texas Highway in Austin, Texas, on or about July 10, 2015, and in times prior thereto, the employer's hazard communication program was not implemented in that employees who were using chemicals such as alkaline Laticrete 4-XLT Tile And Stone Adhesive powder had not seen any written information on the chemical other than label information, and were not aware of the location of the written hazard communication program or material safety data sheets, exposing employees to the hazards of alkaline chemical contact, including alkali burns.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information: (Construction Reference: 1926.59)  At the construction site located at 320 Capitol of Texas Highway in Austin, Texas, on or about July 10, 2015, and in times prior thereto, hazard communication training did not include how to read a material safety data sheet for employees who were mixing alkaline Laticrete 4-XLT Tile And Stone Adhesive powder and setting tile, exposing employees to the hazards of alkaline chemical contact, including alkali burns.

29 CFR 1926.102(a)(1): Eye and/or face protective equipment was not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) At the construction site located at 320 Capitol of Texas Highway in Austin, Texas, on or about July 10, 2015, and in times prior thereto, safety glasses with side shields were provided in lieu of chemical splash goggles or faceshield for employees who were mixing alkaline Laticrete 4-XLT Tile And Stone Adhesive powder, exposing employees to the hazards of alkaline chemical splashes, including alkali burns.  (b) At the construction site located at 320 Capitol of Texas Highway in Austin, Texas, on July 10, 2015, where employees were scoring and snapping 13-inch x 13-inch porcelain tile and installing tile overhead on shower walls, the employer did not ensure that employees wore personal protective equipment for eyes and/or face, exposing employees to the hazards of being struck by tile pieces.
