29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) Chipper Saw operator: On or about August 13, 2015 and at times prior thereto the employer exposed an employee to noise levels of 191.6% (equivalent to an 8 hour time weighted average (TWA) of 94.6 dBA) which is 3.832 times the Action Level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the chipper saw. Results were calculated for 378 minutes sampling period and included zero increment for the 102 minutes not sampled. The employer did not develop and implement a monitoring program. b) Head Saw Helper: On or about August 13, 2015 and at times prior thereto the employer exposed an employee to noise levels of 83.7% (equivalent to an 8 hour time weighted average (TWA) of 88.7 dBA) which is 1.674 times the Action Level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working at Head Saw platform. Results were calculated for 411 minutes sampling period and included zero increment for the 69 minutes not sampled. The employer did not develop and implement a monitoring program.
