On or about August 11, 2015, and at times prior thereto, the employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) would be met. This condition exposed employees to health hazards.

29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. On or about August 11, 2015, and at times prior thereto, the employer did not require employees to wear respirators that will protect employees from the hazards of silica. These conditions could potentially exposed employees to health hazards such as but not limited to silicosis.
