29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: The employees installing a new sewer drain along 377 in Benbrook, Texas were exposed to cave-in hazards by an inadequate sloping of the east wall. The employer failed to ensure that the trench met the sloping requirements as outlined in 29 CFR 1926.652(c). The Texas Sterling Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 315624999, citation number 1, item number 1 and was affirmed as a final order on July 15, 2011, with respect to a workplace located at 21000 Bulverde Rd., San Antonio, Texas 78259.
