OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees, other than the operator, were permitted to ride the Wirtgen W120 Fi milling machine when seating, seat belts, or other protection equivalent to that provided for the operator, were not provided: (a) Route 50: On or about August 13, 2015, and times prior, employees, other than the operator, were permitted to ride the Wirtgen W 120 Fi milling machine, while in operation, exposing employees to crushing injuries. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a) Route 50: On or about August 13, 2015, and times prior, the employer did not comply with the requirements of this standard when an unsafe condition that occurred at the worksite on a regular basis and was in violation of a company rule and the equipment manufacturer's recommendation. Employees were regularly permitted to ride as passengers on the Wirtgen W120 Fi milling machine when that machine did not have seating for anyone other than the operator. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED FOR THIS ITEM
