29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) For the establishment at 12415 73rd Ct., Largo, FL 33773, as observed on or about 08/14/2015, employees operated a TCM FCG15 propane forklift daily at the facility. Forklift operators had never received any forklift training and evaluation and were observed to not wear seat belts while operating the forklift.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) For the establishment at 12415 73rd Ct., Largo, FL 33773, as observed on or about 08/14/2015, employees operated a TCM FCG15 propane forklift daily at the facility. The forklift was unsafe and in need of repair in that it had no backup alarm and it's headlights did not work.
