29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) On August 17, 2015, near the north end and west side interior of the project, there was no fall protection for employees around the 6 foot, 8 inch by 2 foot, 8 inch opening in the attic floor that was used to access the attic. Employees that used the opening to access the attic area were exposed to the hazard of falling from a height of about 12 feet, 1 inch to the concrete below. (b) On August 17, 2015, near the north end and east side interior of the project, there was no fall protection for employees around a 6 foot, 8 inch by 3 foot opening in the attic floor. Employees that worked next to the opening were exposed to the hazard of falling from a height of about 12 feet, 1 inch to the concrete below.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step: On August 17, 2015, near the north end of the project on the west side, the top and top step of a 12 foot Werner stepladder were used to egress from an attic. Employees that used the ladder were exposed to the hazard of falling from a height of about 12 feet, 1 inch to the concrete surface below.
