29 CFR 1910.266(h)(2)(ii): Before each tree is felled, conditions such as, but not limited to, snow and ice accumulation, the wind, the lean of tree, dead limbs, and the location of other trees, was not evaluated by the feller and precautions taken so a hazard is not created for an employee:    (a) Felling Area, Haymond Run:  The employer failed to ensure precautions were taken prior to performing manual tree felling operations for the hazards of potentially broken/dead tree limbs located in adjacent trees.  The employee was exposed to a struck by hazard from a falling branch during manual felling operations, as determined on August 20, 2015. The fatality was reported not reported to OSHA until August 14, 2015 at 08:00 am, as determined on August 14, 2015.

29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a) Larry Jones Jr. dba Jones Hauling:  Employees used gasoline and diesel fuel which are flammable liquids, Pure Guard AW-46 and Chevron 1000THF hydraulic fluids which contain mineral oils.  The employer did not developed and implemented a written hazard communication program, as determined on August 20, 2015.   ABATEMENT NOTE:  A written program shall include a description of how the criteria for the following will be met:  1.        Labeling and other forms of warnings;  2.        Safety Data Sheets;  3.        Employee information and training.      Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and the availability of safety data sheets must also be addressed.  The written program must be made available upon request.   Abatement Certification Required for this Item.
