29 CFR 1926.20(b)(2):  Employer did not provide programs for frequent and regular inspections of the job sites, materials, and equipment to be made by a competent person designated by the employer:          (a)  Rafael Cohete, 296 South Grant Street, Denver, CO:  On or about August 19th, 2015, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees shingling a roof without fall protection. The condition exposed the employees to a fall hazard of approximately 12 feet.   Abatement Note: OSHA defines a competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   (a)  Rafael Cohete, 296 South Grant Street, Denver, CO: On or about August 19th, 2015, employees installing new asphalt shingles while standing on a 10/12 pitch roof were not wearing Personal Fall Arrest Systems (PFAS). Condition exposed employees to a fall hazard of approximately 12 feet.   Abatement Note:  Abatement certification is not required for this item.

29 CFR 1926.1053(b)(1): Because of the portable ladders length, the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist the employees in the mounting and dismounting the ladder:   (a)  Rafael Cohete, 296 South Grant Street, Denver, CO:  :  On or about August 19th, 2015, the controlling employer did not ensure employees utilizing portable ladders in such a way that enabled them to access and egress from the roof using ladders that extended 3 feet above the walking and working surface. Employees were using a portable extension-ladder for access to a 10/12 pitch roof. Employees were exposed to a fall of approximately 12 feet while attempting to use the ladder.
