29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) Painter(s) are provided and required to use powered air purifying respirator for protection from airborne paint mist and vapors during automotive spray painting. A written compliance program was not developed by the employer to address selection, use, care & storage of respirator(s); as well as providing for medical approval & training of user(s).    Condition(s) were noted on or about 8/21/2015.

29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  a) Powered air purifying hooded respirators are provided & required by the employer for use by painter(s) as personal protection from aerosol & vapor inhalation during spray-painting within the spray booth.  Each user of such respiratory protection was not provided with a medical evaluation to determine their ability to wear a respirator.  Condition(s) were noted on or about 8/21/2015.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a) Automotive coatings mixed and sprayed by painter(s), along with adhesive(s) & thinner solvent(s) contain volatile organic compounds with inhalation health hazards as well as flammability properties. A written plan for communicating hazard information about these chemicals to the workers who handle them was not developed.     Condition(s) were noted on or about 8/21/2015

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  (a) Training was not provided to employees based on the requirements of the OSHA Hazard Communication Standard, as well as the new pictogram system of container labels and Safety Data Sheets. Body shop employee(s) use adhesives, petroleum-based solvent(s) & various automotive coatings with inhalation health hazards as well as flammability properties.   Condition(s) were noted on or about 8/21/2015.
