29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, stucture, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: a) Worksite, 2421 Hewlett Ave., Bellmore, NY- Employees climbed the frames and crossbracing of a fabricated frame scaffold to access the 12' level; on or about 8/22/15. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems. a) Worksite 2421 Hewlett Ave., Bellmore, NY, - Two employees were observed working at the edge of the portico, approximately 15 feet above the ground below. The employees were not protected from falling, by guardrail systems, safety net systems or personal fall arrest systems on; on or about 8/22/15. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
