29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about August 20, 2015, the employer did not adequately determine the Personal Protective Equipment (PPE) required for hazards present at this workplace, such as but not limited to: 1. Fall hazards- Employees conducted grain sampling operations from two inadequately guarded platform openings greater than nine feet in height located on the east side without fall protection. 2. Struck-by hazards- Employees conducted grain processing sampling operations underneath a platform greater than nine feet in height without protective head gear.
