29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees: a) The employer did not ensure that its employee(s) were protected from the chemical hazards, such as but not limited to Crystalline Silica Quartz and Portland Cement, of the site by means of personal protective equipment. Employees were exposed to serious dermal hazards. b) The employer did not ensure that the employees of its subcontractor were protected from the chemical hazards, such as but not limited to Crystalline Silica Quartz and Portland Cement, of the site by means of personal protective equipment. Subcontracted employees were exposed to serious dermal hazards.
