29 CFR 1910.178(l)(6): The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. (a) Receiving area - An employee used a Clark C500-45 forklift but the employer did not certify that each operator had been trained and evaluated as required, reported on 8-21-15. Abatement certification required.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. (a) Receiving Area - Employees used a Clark C500-45 powered industrial truck that was not taken out of service even though the truck had reduced braking capacity and a small hydraulic leak, observed on or about 8-21-15. Abatement certification required.
