29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) Roof, new residential construction located on Lot #164 Still Pine Bend, Smyrna, GA 30082: Employees were exposed to struck-by eye injuries while operating Hitachi (Model - NV45AB2) Coil Roofing Nail Guns at 120 PSI with no protective eyewear. Employees were exposed to flying metal debris and fasteners as safety goggles, glasses or face shields were not provided by the employer.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) Roof, new residential construction located on Lot #164 Still Pine Bend, Smyrna, GA 30082: Employees were exposed to falls while working from a 8/12 pitched roof at heights of approximately 20-feet, 6-inches without an adequate fall protection system in place. Employees used mountain climbing/rappelling harnesses and equipment as fall protection and at times were not attached to the life-lines.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators:    (a) Front side, new residential construction located on Lot #164 Still Pine Bend, Smyrna, GA 30082: Employer allowed employees to use the TranzSporter (Model LH200) Material Platform Hoist as ladder to access the roof. Manufacturer's general safety instructions state that this hoist should never be used as a ladder and that it is for materials only not personnel.
