OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while being exposed to being infected with M. tuberculosis:   On or about August 13th, 2015, while entering rooms housing patients with suspected or known active tuberculosis, physicians were exposed to the potential hazard of acquiring an M. tuberculosis infection yet did not participate in an effective TB screening program that would provide individual medical information that would allow effective treatment.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  On or about August 13th, 2015, at the above address jobsite, the employer had not fit-tested physicians that would wear an N95 filtering facepiece respirator before entering isolation rooms.

29 CFR 1910.1030(h)(1)(ii)(B): A copy of the employee's hepatitis B vaccination status including the dates of all the hepatitis B vaccinations and any medical records relative to the employee's ability to receive vaccination as required by paragraph (f)(2) were not kept:   On or about August 13th, 2015, at the above address jobsite, the employer did not have records for physicians, which included the status of Hepatitis B vaccination and dates received.
