29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a) Fullerton Building System/Christiana Fashion Center - On or about August 18, 2015, an employee performing finishing work on a newly constructed commercial structure was approximately twenty to twenty-five feet from ground level while working from a lift without the use of a personal fall arrest system or personal fall restraints.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Fullerton Building Systems/Christiana fashion Center- On or about August 18, 2015, the employer did not provide information and training to his employee in the recognition, evaluation, and control of hazards associated with working at elevations. Employees were working from and aerial lift without the use of fall protection.
