John's Just a Cut Better Tree Service, 107 Arnold Ave., Beckley, WV:  On or about 08/21/15, a Husqvarna chainsaw was in use with a broken chain brake.  ABATEMENT CERTIFICATION IS REQUIRED.

John's Just a Cut Better Tree Service, 107 Arnold Ave., Beckley, WV:  On or about 08/21/15, the employer did not train an employee in safe tree trimming operations around live power lines prior to allowing him to perform tree trimming operations within 2' of a residential power line. 29 CFR 1910.269(r)(1)(i): Before an employee climbs, enters, or works around any tree, a determination was not made of the nominal voltage of electric power lines posing a hazard to employees:   a.)  John's Just a Cut Better Tree Service, 107 Arnold Ave., Beckley, WV:  On or about 08/21/15, the employer did not determine the nominal voltages of the residential power lines prior to having an employee climb a tree and perform tree trimming operations within 2' of the lines.  Note: A determination of the maximum nominal voltage to which an employee will be exposed may be made instead, if all lines are considered as energized at this maximum voltage.    ABATEMENT DOCUMENTATION IS REQUIRED.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a.)  John's Just a Cut Better Tree Service, 107 Arnold Ave., Beckley WV:  On or about 08/21/15, an employee used a Stihl chainsaw with a 16" bar to remove limbs from a tree without the use of cut-resistant leg protection.  b.)  John's Just a Cut Better Tree Service, 107 Arnold Ave., Beckley WV:  On or about 08/21/15, an employee used a Husqvarna 445 chainsaw with a 18" bar to remove limbs from a tree without the use of cut-resistant leg protection.   John's Just A Cut Better Tree Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.132(a), which was contained in OSHA inspection number 896168, citation number 1, item number 1a and was affirmed as a final order on November 1, 2013, with respect to a workplace located at 111 Reservoir Road, Beckley WV.  ABATEMENT DOCUMENTATION REQUIRED FOR THIS ITEM
