29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:      On or before August 18, 2015, the employer failed to ensure that the employee was wearing the prescribed PPE.  Instead the employee wore a Lakeland Pyrolon Apron when working with Waste Stream 117779-5 to perform the work.    Heritage Thermal Services, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.132(a), which was contained in OSHA inspection number 281555, citation number 1, item number 1 and was affirmed as a final order on September 27, 2012, with respect to a workplace located at 1250 St. George St. E. Liverpool, Ohio 43920.

29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment:    On or before August 18, 2015, the employer failed to reassess and reselect appropriate personal protective equipment necessary to protect employees from the hazards associated with Waste Stream 117779-5, which include but are not limited to, p-chloroaniline. The employer failed to reassess the personal protective equipment when changing the p-chloroaniline from a solid to vapor during the steaming process. Appropriate personal protective equipment would include a full body suit that was impervious to p-chloroaniline and a self containing breathing apparatus (SCBA).      Heritage Thermal Services, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.132(d)(1)(i), which was contained in OSHA inspection number 281555, citation number 1, item number 2 and was affirmed as a final order on September 27, 2012, with respect to a workplace located at 1250 St. George St. E. Liverpool, Ohio 43920.

29 CFR 1910.134(g)(2)(i): The employer did not ensure that appropriate surveillance was maintained of work area conditions and degree of employee exposure or stress in order to reevaluate the continued effectiveness of the respirator:    On or before August 18, 2015, the employer required an employee working with Waste Stream 117779-5 to perform the work while wearing 3M Full Facepiece Respirators (7800 Series) with combination cartridges.  The employee was exposed to the chemicals in Waste Stream 117779-5, including but not limited to p-chloroaniline as evidenced by higher than normal methemoglobin levels found in the employee.  The employee was using steam in the south bay to declog a discharge valve.  The employees work area conditions and degree of employee exposure or stress were not reevaluated to assess the effectiveness of the respirators.     Heritage Thermal Services, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(g)(2)(i), which was contained in OSHA inspection number 281555, citation number 1, item number 4 and was affirmed as a final order on September 27, 2012, with respect to a workplace located at 1250 St. George St. E. Liverpool, Ohio 43920.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes:    On or before August 18, 2015, the employer failed to require an employee working with Waste Stream 117779-5 to wear butyl gloves. The employee performed the work while wearing Stanzoil (style NL 34) neoprene gloves and nitrile gloves (style G-10).  The gloves did not provide adequate protection from chemicals in Waste Stream 117779-5, including but not limited to p-chloroaniline as evidenced by higher than normal methemoglobin levels found in the employee.
