29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure:    On the jobsite located at 640 Pearl Street, Lyons, NE: The employer is failing to ensure that employees engaged in residential construction activities are protected from falls heights greater than 6 feet from lower levels.     On or about August 26, 2015, employees of Saul Prieto dba Prieto General Construction were observed installing asphalt shingles while exposed to fall distances of approximately 15.3 feet on the house and 9 feet on the detached garage without acceptable means of fall protection as required by this subpart.

On or about August 26, 2015 Employees of Prieto General Construction were observed installing asphalt shingles and exposed to fall distances greater than 6 feet without adequate fall protection such as but not limited to guardrails, safety nets, personal fall arrest systems, etc.

On or about August 26, 2015; employees of Prieto's General Construction were required to carry bundles of asphalt shingles onto the roof for installation.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:   On the East side of the detached garage of the jobsite located at 640 Pearls Street, Lyons, NE:    The employer is failing to ensure that ladders used by employees are used for purposes for which they were designed. On or about August 26, 2015; employees of Prietos General Construction were observed using a 10-foot, A-Frame stepladder to access the roof of the garage to perform shingle installation.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  On the jobsite located at 640 Pearl Street, Lyons, NE: The employer is failing to provide a training for employees that use ladders and/or stairways. On or about August 28, 2015; employees were exposed to unsafe ladder use in that ladders used to access upper levels did not extend at least 3 feet above the level being accessed, self supporting ladder was used to access the roof of the detached garage and employees were allowed to carry asphalt shingle bundles up the ladder to the roof.
