OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Liquid Transfer Georgia, Inc., on or about August 19, 2015, and times prior to, the employer did not ensure that the Sodium Hydrosulfide Tank (B-13) in the liquid storage terminal was inspected at the inspection intervals dictated by recognized and generally accepted good engineering practices (API 653).

1910.252(a)(2)(vi)(c): Cutting and welding were permitted in the presence of explosive atmospheres (mixtures of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that may develop inside uncleaned or improperly prepared tanks or equipment which previously contained such materials, or that may develop in areas with an accumulation of combustible dusts: a) Sodium Hydrosulfide Solution Tank B-13, on or about August 19, 2015, the employer allowed arc welding on top of an atmospheric storage tank where an explosive atmosphere could develop due to the presence of a flammable residual hydrocarbon layer on top of the sodium hydrosulfide stored in the tank.
