29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Building #2, east side: On or about August 27, 2015, and at times prior thereto, an employee was exposed to the hazard of falls by not connecting the lanyard to the aerial basket while painting the stucco sections.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Building #2, east side: On or about August 27, 2015, and at times prior thereto, an employee was exposed to a fall hazard of greater than 6 feet or more to the ground, while painting the stucco columns of residential construction without utilizing a fall protection system or an alternative fall protection plan.
