OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  (a) Market Street in Flowood, MS - On or about August 26, 2015 three employees were exposed to struck-by hazards while working in a roadway adjacent to Hwy 25 without high-visibility apparel.  These employees were exposed to being struck-by vehicular traffic due to lack of high-visibility apparel.

29 CFR 1926.200(g)(1):  Construction areas shall be posted with legible traffic signs at points of hazard.  (a) Market Street in Flowood, MS - On or about August 26, 2015 three employees were exposed to struck-by hazards while working in a roadway adjacent to Hwy 25 without warning signs notifying on-coming traffic that work was being performed ahead. Also these employees were not wearing high-visibility apparel as to be seen by public.

Personal fall arrest system components must be used in personal fall arrest and fall restraint systems and must conform to the criteria in �� 1926.502(d) except that �� 1926.502(d)(15) does not apply to components used in personal fall arrest and fall restraint systems. Either body belts or body harnesses must be used in personal fall arrest and fall restraint systems.  (a)  Market Street in Flowood, MS - On or about August 26, 2015 an employee was exposed to a fall hazard and a potential struck-by hazard while standing on top of a suspended load with no fall protection. This employee stood on top of a sign suspended by a crane. This employee was wearing a harness without the lanyard attached.

29 CFR 1926.1425(e)(2): Only employees essential to the operation are permitted in the fall zone (but not directly under the load). An employee is essential to the operation if the employee is conducting one of the following operations and the employer can demonstrate it is infeasible for the employee to perform that operation from outside the fall zone: (1) Physically guide the load; (2) closely monitor and give instructions regarding the load's movement; or (3) either detach it from or initially attach it to another component or structure (such as, but not limited to, making an initial connection or installing bracing). Note: Boom free fall is prohibited when an employee is in the fall zone of the boom or load, and load line free fall is prohibited when an employee is directly under the load. (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  (a)  Gator Sign Company - On or about August 26, 2015 the employer did not maintain a Hazardous Communication Program.  The Safety Data Sheets (SDS) were not available to employees at the work site.  The employer had two hazardous materials in the work area: oxygen and acetylene with no SDS.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)  Gator Sign Company - On or about August 26, 2015 employer did not instruct his employees on how to avoid or minimize unsafe conditions in the work area.  Employees did not meet the minimum programs requirements by OSHA regulations.  Employer did not provide safety and health training programs to his employees on how to avoid unnecessary injuries or illness. 1) Two employees stood under a suspended load. 2) One employee stood on top of a suspended with no fall protection. 3) Three employees stood in an active road way with no high visibility clothing. 4) Three employees stood in an active road way with no signs posted to warn traffic. 5) Two employees stood under a suspended load with no hardhats.
