29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1):  (a) Establishment: Employees who were required to conduct housekeeping activities including, but not limited to, sweeping and cleaning surfaces in the building were present in the building during the removal of presumed asbestos containing material (PACM), but the presence, location and quantity of ACM or PACM in the building was not determined, therefore the flooring contractor did not treat the material as ACM or PACM thus potentially exposing employees to asbestos, on or about August 28, 2015.

(b) Dairy/Coffee Room: Thermal Insulation that was on plumbing in the building that was built prior to 1980 should have been treated as presumed asbestos containing material (PACM), but was not marked or identified as such or about August 28, 2015.  (c) Meat pantry: Thermal Insulation that was on plumbing in the building that was built prior to 1980 should have been treated as presumed asbestos containing material (PACM), but was not marked or identified as such or about August 28, 2015.  (d) Flooring and Mastic throughout the first and second floors: Surfacing material in the building that was built prior to 1980 should have been treated as presumed asbestos containing material (PACM), but was not marked or identified as such or about August 28, 2015.
