29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. On and before August 31, 2015, the Finn hydro seeder elevated platform, approximately 8.5 feet above the ground, had a guard railing system that was 34 inches above the walking/working surface of the platform. This does not meet the requirements for a standard railing which is 42 inches.
