29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Toledo Shredding, LLC - Toledo, Ohio: On or about September 1, 2015, employees accessing and working from the shredder platform were exposed to falls of approximately 10 to 12 feet. Sections of the platform's guardrail were incomplete in that a portion of the mid-rail was missing and a complete guardrail was absent to protect operators from falls between the platform and the shredder.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: Toledo Shredding, LLC - Toledo, Ohio: . On or about September 1, 2015, employees accessing an elevated platform, located between the shredder and mechanical room, to perform repairs on the shredder were exposed to an approximate ten foot fall hazard. The employer did not ensure fall protection was available and used while on the platform. Employees accessed the platform through a door and staged a ladder on the platform to reach portions of the shredder.
