29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a) For employees working at 437 South Nokomis Ave located in Venice, on or about September 1,2015. Employees were on a window rack that was being utilized as a scaffold platform, and was not attached to the forks of a rough terrain forklift while the forklift was moved horizontally.

29 CFR 1926.602(c)(1)(vii): Unauthorized persons were allowed to ride on a powered industrial truck:  a) For employees working at 437 South Nokomis Ave located in Venice,  three employees were allowed to ride in a window rack elevated by a forklift, JCB model 506HL, while it was repositioned. The employees fell approximately 7 feet, on or about September 1, 2015 when the rack fell off the forks.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:  a) For employees working at 437 South Nokomis Ave located in Venice,  three employees were riding in a window rack being used as a platform when the window rack fell from the elevated forks while the forklift, JCB model 506HL, was being repositioned. The employees fell approximately 7 feet, on or about September 1, 2015.
