Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the tipping of unsecured high pressure nitrogen cylinders: a) On or about 9/01/15, on construction site at 3021 Orchard Park Rd., Orchard Park, NY: One high pressure nitrogen cylinder was in use with gauges attached and a spare high pressure nitrogen cylinder next to it was in-storage. Both cylinders were standing upright and neither was secured to anything and could tip over if bumped. NO ABATEMENT CERTIFICATION REQUIRED
