29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a) Production - The employer failed to ensure that adequate methods of guarding were used to protect employees from the pinch point created by the back gauge located behind the die on the Amada press brake during operation.    On June 4, 2015 an employee suffered an amputation when the employees finger was pinched between the part and the back gauge while operating the Amada Press serial# 509703.        In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of the incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov:      a) The employer did not report an in-patient hospitalization that was the result of a work-related incident to OSHA within twenty-four (24) hours for an injury that occurred on June 4, 2015.
