29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about September 1, 2015, the employer failed to ensure that employees working at lower levels of a scaffold system and at the ground level of a worksite were protected by protective helmets. Work was being performed by employees at the higher levels. The hazard was present at a worksite located at 5555 Youngstown- Warren Road, Niles, OH.

29 CFR 1926.451(e)(1): Where scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access:       On or about September 1, 2015, during plaster masonry activities the employer did not ensure employees working from a fabricated frame type scaffold had a ladder or other safe means to access the working platforms of the scaffold, located approximately 24 feet above the ground.  Employees were climbing the ends and cross braces to access the working platforms of the scaffold. Means of access were not on site for employee use.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a) On or about September 1, 2015, during plaster masonry activities the employer did not ensure employees working from a fabricated frame type scaffold were protected from falling by a guardrail, personal fall arrest, or other fall protection system.  The top work level were employees were working was approximately 24 feet above the ground. It contained no guardrails. The second level were employees were working was approximately 16 feet above the ground. It did not contain guardrails.    b) On or about September 1, 2015, during plaster masonry activities the employer did not ensure employees working from a wooden plank supported by the scaffold system and building itself were protected from falling by a guardrail, personal fall arrest, or other fall protection system.  The top work level were an employee was working was approximately 24 feet above the ground. It contained no guardrails.
