29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On 9/3/15, at the worksite at 2448 Market St. in Harrisburg, PA, a hardhat or other head protection was not being worn by employee(s) exposed to being struck by falling branches, wood and equipment while gathering branches and working beneath the bucket of the aerial lift from which branches were being cut and dropped to the ground. b) On 9/3/15, at the worksite at 2448 Market St. in Harrisburg, PA, eye protection was not being worn by employees exposed to particles flying out of the wood chipper while feeding branches into the chipper. No Abatement Documentation or Certification Required.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: a) The worksite had not been assessed for necessary personal protective equipment. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
