OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees worked in an enclosed environment at around 127 degrees Fahrenheit performing work that exposed workers to excessive heat: On or About September 1, 2015, four employees and a supervisor were exposed to the hazard of excessive heat. One employee experienced a work-related illness/injury with dehydration, muscle injury (rhabdomyolysis) and acute kidney injury secondary to heat exhaustion from exposure to excessive heat and exertion in the workplace. In addition, two co-workers experienced mild work-related heat illnesses. The employer failed to ensure that employees working were acclimatized to the heat, that work-rest cycles and hydration intervals were sufficient to prevent heat illness and that supervisor and employees were provided effective training in the recognition of signs and symptoms, predisposing risk factors, and prevention of heat-related illnesses.
