OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards caused by the movement and slipping of the 1600 pound quick coupler. The coupler was not secured to the ground, but rather it was placed under a 12-Ton jack-stand. On or about August 27, 2015 - An employee engaged in quick coupler installation activities at the Komatsu loader was exposed to struck-by hazards in that the coupler was not positioned in a manner which prevented unintentional movement prior to installing the retaining pins. Among other means, one feasible and acceptable method to abate this hazard is to place the coupler flat on level ground as required by the JRB Operator's Manual. Develop safe use and written procedure for installing coupler in accordance with the manufacturers.

29 CFR 1904.39(a)(3): The employer did not report the fatality, in-patient hospitalization, amputation, or loss of an eye within the 24 hour time period by using one of the following methods: (i) By telephone or in person to the OSHA Area Office that is nearest to the site of the incident. (ii) By telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742): On or about August 27, 2015 - An employee was injured in the workplace requiring a hospital stay and was not reported to OSHA until September 08, 2015.
