Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where employees were exposed to crushing hazards: (a) For the employees exposed to crushing hazards where the Caterpillar CB-534B Compactor was not provided with roll over protection near the intersection of 64th Street NW and 148th Avenue NW Williston, ND. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements found in the Society of Automotive Engineers which has recognized the lack of ROPS as a hazard. SAE has established specifications under SAE J1040b (1977) for new equipment manufacturing and old equipment retrofitting to protect employees on compactors.
